Le Pen: The day after – The future of France’s populist right amid council of State Decision on appeal
Le Pen’s legal saga is far from over.
France’s Council of State has rejected the appeal of National Rally (RN) leader Marie Le Pen against her immediate disqualification, imposed in March.
The case concerns the employment of European Parliament assistants by the National Front – now the National Rally (RN). Between 2004 and 2016, the party channeled €2.9 million from the European Parliament directly to its Paris headquarters, paying staff who were formally parliamentary assistants but in practice worked for the party.

Le Pen had challenged her exclusion from the electoral lists, requesting the Council of State to prioritize referral of the case to the Constitutional Council. In other words, she wanted the court to review whether the law used to bar her candidacy was constitutional.
Had this request succeeded, it could have delayed or overturned her disqualification from upcoming elections.

During the summer, MEP Olivier, Le Pen’s senior adviser, told Brussels Signal that the party would “exhaust every legal option available” regarding Marine Le Pen’s conviction.
However, now that this effort has failed, she remains barred from any future parliamentary or presidential elections.

Le Pen’s legal saga continues. Her trial is scheduled from January 13 to February 12, with a decision expected in the summer – well ahead of the 2027 deadline, the year of France’s next presidential elections.
