But over the weekend, Judge John J. McConnell Jr. (Rhode Island) overturned this strategy, ordering the president to use "financial reserves" from the US Department of Agriculture to keep SNAP operational.
The president responded with a dose of caution, saying: "If given the proper legal directions by the Court, I will be HONORED to provide the funding."
But given that the reserve fund contains only $5.25 billion and the actual cost to continue SNAP through November is $8.5 billion, we have a math problem. Thus, we wait to see how Judge McConnell will explain which legal directions can solve this problem.
The president may have proven that federal judges are not capable of exercising his duties under Article II of the Constitution and why the Constitution was written as it is.
